App Terms
Effective date: October 26, 2026 · Version: 2026-10-26
These Terms govern your use of the Elevera Health app (the “App”). The App is offered by Elevera Health PLLC (doing business as Elevera Health), a telehealth medical practice, and is built and published by T and T Solutions LLC (together, “we” or “us”). By creating an account or using the App, you agree to these Terms and to our Privacy Policy.
1. Not medical advice; emergencies
- The App is a personal tracking and wellness tool. It does not diagnose, treat or replace care from your provider. Using the App does not, by itself, create a provider–patient relationship.
- The App records the plan your provider prescribed. It never recommends a dose or a change to your treatment. Follow your provider’s instructions and your pharmacy label.
- Syringe units shown for compounded medications are a convenience conversion, calculated from the vial details you enter. Always check them against your pharmacy label and your provider’s instructions before drawing a dose. You are responsible for entering vial details accurately.
- Educational content, recipes, workouts and programs are general information. Check with your provider before starting new exercise or diet changes.
- Workout plans are built automatically from the preferences you choose, using general exercise guidelines. They are not personalized medical or physical-therapy advice.
- Use weights and an effort level that feel safe for you, and learn proper form.
- Stop and seek care if you feel chest pain, dizziness, faintness, unusual shortness of breath or joint pain.
- Check with your provider before starting, especially if you have a heart, joint or other medical condition, are pregnant, or recently changed your medication.
- In an emergency, call 911. For questions about your care, message your provider in Spruce or call (703) 952-3366. The App is not monitored by clinicians, and nothing you enter in the App is sent to your care team.
2. Eligibility and accounts
- You must be 18 or older.
- Keep your sign-in secure. You’re responsible for activity on your account. Tell us right away if you think someone else has used it.
- Give accurate information. We may suspend or close accounts used in violation of these Terms.
3. Acceptable use
Don’t misuse the App. That includes:
- trying to access other people’s data or our systems
- interfering with the service or uploading malicious files
- scraping or copying content in bulk
- reverse engineering the App, except where the law allows it
- uploading content you don’t have the right to share
Photos you upload must be your own progress photos.
4. Your content
You own the information and photos you add. You give us permission to store and process them only to provide the App to you, as described in the Privacy Policy. You can delete your account and data at any time.
5. Our content and license
The App, its design and its content (recipes, workouts, exercises, programs, articles and logos) belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal and non-commercial purposes, under these Terms and the rules of the app store you got it from.
6. Changes and availability
We may update, suspend or discontinue features. We may also require you to update the App to keep using it. We’ll tell you about material changes to these Terms in the App, and ask you to accept them before you continue.
7. Disclaimers
To the extent the law allows, the App is provided “as is” and “as available”, without warranties of any kind, express or implied. That includes warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability. Some states don’t allow certain warranty exclusions, so some of these may not apply to you.
8. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of the App. Our total liability for any claim relating to the App is limited to $100. Nothing in these Terms limits liability that can’t be limited under the law, including for the professional medical care Elevera Health provides outside the App.
9. Ending your use
You can stop using the App and delete your account at any time (Me → Settings → Delete my account, or see Delete your app account). We may suspend or end your access if you violate these Terms. Sections 4–5 (as to our content), 7, 8, 10 and 11 continue to apply after your access ends.
10. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Loudoun County, Virginia, unless the law of your state requires otherwise. Before filing a claim, please contact us through our contact form or Spruce so we can try to resolve it informally.
11. App store terms
Apple. If you got the App from the Apple App Store:
- These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content.
- Your license is limited to using the App on Apple-branded products you own or control, as the App Store Terms of Service allow.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any (the App is free). To the extent the law allows, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for any claims relating to the App or your use of it. That includes product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
- If a third party claims the App infringes its intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not located in a country subject to a U.S. government embargo or designated as “terrorist supporting”, and that you are not on any U.S. government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use the App, such as your wireless carrier’s terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple can enforce them against you as a third-party beneficiary.
Google. If you got the App from Google Play, Google Play’s terms also apply, and Google is not responsible for the App or its content.
12. General
If any part of these Terms is found unenforceable, the rest stays in effect. If we don’t enforce a right, we haven’t waived it. These Terms and the Privacy Policy are the entire agreement between you and us about the App.
